Terms of Service

Welcome to Lunixify Studio. These Terms of Service ("Terms") constitute a legally binding agreement between you (“the Client”) and Lunixify Studio (“us”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Services Provided

Lunixify Studio offers a variety of services, including but not limited to:

• Custom website design and development

• UI/UX design

• Product Motion design

• Sale of digital design and development templates for platforms such as Framer, Figma.

• Ongoing website maintenance, performance optimization, and technical support.

We reserve the right to modify or discontinue any service at our sole discretion.

2. User Responsibilities

By using our Services, you agree to:

• Provide accurate, complete, and up-to-date information as requested

• Use our Services only for lawful purposes

• Not misuse or interfere with the functioning of our website or Services

• Respect the intellectual property and proprietary rights of Lunixify and others

You are solely responsible for all activity under your usage of our Services.

3. Payments and Pricing

• All pricing for services and products is listed on our website or communicated via proposal or invoice.

• For digital templates, payment must be made in full before access is granted.

• For custom design or development projects, a deposit of 50% is required before work begins, with milestone payments based on the agreement of 75% after the first delivered version of the product and 100% after delivery of the product.

• Due to high quality and time consuming of our work, all payments are non-refundable unless otherwise stated in writing.

• We use secure third-party payment processors. You agree to their terms and privacy policies.

• Lunixify Studio reserves the right to update pricing at any time. Pricing changes do not affect already contracted or purchased services.

4. Refund and Cancellation Policy

• Digital Templates: All purchases of downloadable digital templates are final. No refunds will be issued once the product has been accessed or downloaded.

• Custom Services: Cancellations for custom design or development services must be made in writing. Refunds will be determined based on the stage of work completed and expenses incurred. A minimum 45% of the project fee is non-refundable due to withholding taxes and for planning and onboarding time.

• Due to high quality and time consuming of this work, there’s no any refund after agreement of the project final design.

5. Intellectual Property Rights

• All materials, including but not limited to design files, source code, templates, graphics, logos, and text, created or provided by Lunixify remain our intellectual property unless otherwise agreed in writing.

• When you purchase a template, you are granted a non exclusive, non-transferable license to use it for personal or commercial projects only.

• You may not resell, redistribute, sublicense, or claim our templates or custom work as your own without prior written consent.

• For custom development projects, the final deliverables become the property of the client upon full payment, unless stated otherwise.

6. Client Content and Materials

• You retain full ownership of all content, media, and data you supply to us.

• You grant Lunixify a limited license to use, modify, display, and reproduce such content solely for the purpose of delivering the agreed-upon Services.

• You are responsible for securing rights to any third-party content you provide and agree to indemnify Lunixify against any claims relating to it.

7. Confidentiality

We will not disclose any confidential or proprietary information shared by you unless required by law or with your written consent. Likewise, you agree not to share any confidential details about our pricing structures, internal processes, or source code.

8. Limitation of Liability

To the maximum extent permitted by law, Lunixify Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from or related to your use of our Services. Our total liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid to us in the three months prior to the claim.

9. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. You may also terminate the relationship by notifying us in writing. Any outstanding fees and obligations must be settled before termination is complete.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Uganda/or USA laws as Lunixify studio LLC is an USA based company. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Uganda ( Or in USA on the name of the company).

11. Amendments and Updates

We reserve the right to update these Terms at any time. We will notify users of significant changes via our website or email. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.
